Court rules rapist must pay for hospital exam

DENVER – The Colorado Court of Appeals has ruled that a man who raped a 14-year-old child must pay the hospital for the girl’s medical examination.

The court said Thursday that Aaron Montanez should pay the girl’s $650 hospital bill after the child’s mother took the child to the hospital in 2009. Because the examination was not ordered by Colorado Springs police, the mother was billed for the hospital visit.

The mother refused to pay and a lower court said Montanez was only partially responsible for the debt.

According to court records, Montanez pleaded guilty to sexual assault on a child and was sentenced to 10 years to life probation.
