Judge orders Montrose dog to be euthanized; appeal planned

A Montrose judge early this afternoon ordered a dog who attacked and severely injured a woman in November to be euthanized, while the attorney for the dog’s owner said he would appeal the decision.

Municipal Judge Richard Brown also ordered the owner, Jeremiah Aguilar, to pay a $500 fine and spend two days in jail for harboring a vicious dog, a violation of city codes. The dog, Dutch, will be in the custody of Montrose County Animal Services until the case is settled.

Aguilar is the owner of Dutch, an American Allaunt who attacked a woman who was trying to break up a fight between Dutch and a pit bull on Nov. 14. The woman, who had previously owned Dutch, struck Dutch with a tiki torch pole, then pulled him away from the pit bull by Dutch’s collar, according to Montrose city officials.

Officials say when the woman took Dutch inside the house to clean him up, the dog attacked her, biting her thigh and buttocks and, after she freed herself, her hand, severing an artery and causing a compound fracture to her middle finger. Police Chief Tom Chinn said the woman’s medical bills from the attack have totaled about $24,000.

Aguilar, who reportedly is a disabled U.S. Army veteran, and his supporters have described Dutch as an otherwise sweet, gentle dog who was defending himself from what they believe was an attack by the woman against Dutch. The incident has gone viral, with tens of thousands of people joining a “Save Dutch” Facebook group and signing a online petition to prevent Dutch’s euthanasia.

Brown, however, criticized as inaccurate portrayals of the woman on the Internet as a dog abuser.
