Olathe man charged with sex crimes; pattern of abuse revealed in affidavit
MONTROSE — An Olathe man has been charged with having unlawful sex with a 15-year-old girl during a series of sexual encounters dating back to 2008.
Aaron Wayne Brack, 27, 53731 Falcon Road, Olathe, formally was charged with four counts of sexual assault, including sexual assault on a child and sexual assault on a child as a pattern of abuse.
The 15-year-old victim, who does not live in Colorado, was taken to a local hospital by her mother on June 30, 2009, complaining about not feeling well and saying she might be pregnant, according to an arrest affidavit.
The girl told her mother she was in Olathe visiting a relative when she had sex with Brack, who at the time was 26 years old, nearly 11 years older than the victim, the affidavit said. She told investigators she had sex with Brack the first time in June of 2008 and had a total of 10 sexual encounters over the course of the summer. The sexual encounters continued into 2009, and the victim became pregnant, the affidavit said.
The victim told investigators that they didn’t really talk about their relationship, and when they did she thought that they “were not dating, more like friends with benefits.”
According to the report, the girl gave birth to a healthy baby on Feb. 16. On Feb. 23, investigators collected oral swabs from the baby and the mother for DNA testing, and Brack voluntarily submitted an oral swab.
On Oct. 12, the Montrose County Sheriff’s Department received the results that showed the probability that Brack is the biological father of the child is 99.99998 percent.
Brack’s next court appearance is 9 a.m. today.
