Plea deal reached in shooting

A Fruitvale man pleaded guilty today to one felony menacing in a shooting last December in which five men were wounded.

None of the victims of the shooting attended the hearing in which Joshua Anton pleaded guilty to a county of menacing with a deadly weapon.

At least two of the victims will attend the sentencing next week, prosecutor Trish Mahre told Mesa County District Judge Brian Flynn.

Anton fired a handgun into a home at 2984 Krista St., which is next door to his residence.

Original charges included five counts of first-degree assault, with sentence-enhancing charges accompanying assault charge, two counts of second-degree assault, each with sentence-enhancing charges, prohibited use of a weapon and carrying a concealed weapon.

Asked by Flynn why he was willing to plead to a single count filed against him while all the others were dismissed, Anton told Flynn, “Because I feel that I’m guilty of the felony menacing.”

All other charges were dropped in the plea agreement, which also includes a sentence to probation.

Anton can be sentenced to prison only if he violates the terms of probation, Flynn told Anton.

Anton remains in the Mesa County Jail without bond until his sentencing on Aug. 25.
