Bicyclist in accident may face felony DUI charge
A 54-year-old man who was knocked from his bicycle by a car on North 22nd Street on Sunday was arrested on suspicion of driving a vehicle while under the influence.
Benjamin Mascarenas could be charged with a felony count of drunk driving because of his three or more prior convictions, as well as a count of riding a bicycle along crosswalk where prohibited, an arrest affidavit said. The car’s driver reported that she had hit Mascarenas when he rode out in front of her when she was driving southbound on North 22nd Street near Orchard Avenue.
Mascarenas told police he had been riding on the north sidewalk of Orchard Avenue and was hit when he got out to the road. The Grand Junction police officer who wrote the report noted Mascarenas smelled of alcohol, couldn’t complete roadside maneuvers and almost fell over when he tried.
Mesa County Judge Craig Henderson on Monday said the situation was a perfect example of why bicycling while impaired is illegal. Henderson allowed Mascarenas to be released on a personal-recognizance bond.

■ Someone burglarized a business in the 2400 block of U.S. Highway 6&50 Sunday and stole property worth between $2,000 and $5,000.
■ Jessica Fondren, 33, was cited on suspicion of theft Sunday.
