Ex-con held on drug count

A 43-year-old man convicted of second-degree murder 25 years ago was arrested Wednesday afternoon in Grand Junction on suspected drug charges, an arrest affidavit said.

Eric Anthony Gallegos, of 626 N. Seventh St., was arrested after a tipster called dispatch to tell them that he was near his home. Gallegos, who had warrants out for his arrest, allegedly refused to identify himself when approached by a Grand Junction police officer, a report said. He allegedly refused to keep his hands in front of him, the report said.

“I instructed Eric Gallegos to turn around and put his hands behind his back,” the report said. ” Eric Gallegos then quickly reached in his pocket, removed a glass pipe and threw it across the parking lot in (his wife) Susie Gallegos’ direction.”

Eric Gallegos was arrested on suspicion of drug possession, drug paraphernalia possession and tampering.

His wife, who the officer saw stomp on the pipe and break it, was arrested on suspicion of tampering.

Mesa County District Attorney Dan Rubinstein said that, since Gallegos’ release from prison years ago after serving part of a second-degree murder sentence, he has stayed out of trouble for the most part, and most of his current cases are traffic related.

Former District Attorney Pete Hautzinger said Gallegos was convicted at trial of the murder of Jason Gutierrez in 1992.
