Friend of assault suspect claims victim assaulted her
A friend of a man accused of assaulting a disabled veteran created a minor stir Monday in Mesa County Court when she claimed that she was in fact a victim of assault at the hands of the disabled 57-year-old vet.
James Dean Davenport, 50, was arrested Friday in Whitewater, after allegedly attacking his older neighbor over a long-running dispute, according to an arrest affidavit from the Mesa County Sheriff’s Office.
The 57-year-old told a deputy who responded that the altercation escalated after he “spun out” on a gravel road, and Davenport and a woman followed him in separate vehicles. The victim said Davenport confronted him in front of his home on Grand Mesa View Drive, and tried to drag him off into the street, the report said. The deputy noted in the report that the victim had scratches and a torn shirt.
Davenport was arrested on suspicion of assault on an at-risk person and appeared Monday morning before Judge Art Smith in Mesa County Court. As the victim was standing to address the judge during the bond setting, a woman who said she was friends with Davenport preempted him and that she was a victim in the case because the vet had called her a name.
Smith told the woman — who exchanged words with the victim’s family in the courtroom before a victims’ specialist told the group to quiet down — that he was only addressing Davenport’s case.
Davenport was released on a personal-recognizance bond.

■ Samuel Carlson, 20, was cited on suspicion of disorderly house and underage alcohol possession Saturday.
■ Bianca McSwain, 25, is accused of drug possession and other offenses Sunday.
■ Daniel J. Schnoor, 43, was cited on suspicion of driving under the influence Sunday.
■ Desiree Colmenero, 40, is accused of assault and domestic violence Sunday.
■ Someone broke into a vehicle in the 300 block of Talon Drive on Sunday and stole property worth less than $50.
According to the Mesa County Sheriff’s Office:
■ Blaine Jeffs, 61, is accused of driving under the influence Sept. 4.
■ An assault reported in the 400 block of Wedgewood Avenue remains under investigation.
■ A theft was reported in the 500 block of 29½ Road on Thursday.
■ James Davenport, 50, is accused of assault and kidnapping Friday.
According to the Delta Police Department:
■ David A. Garcia, 33, is accused of a drug-related offense Wednesday.
■ Kimberly N. Springer, 30, is accused of burglary Wednesday.

■ Danielle Pena, 21, is accused of harassment and trespass Sunday.
According to the Fruita Police Department:
■ Jonathan S. Buck, 45, was cited on suspicion of shoplifting Aug. 31.
■ John Derasmo, 39, is accused of assault Sept. 3.
■ William McCourt, 37, is accused of assault Sept. 4.
■ William Malone, 83, is accused of driving while ability impaired Sept. 4.
■ Ricky Albaugh, 47, was cited on suspicion of theft and trespass Wednesday.
