Public defender questions legality of search on I-70
A defense attorney representing a man who was arrested Tuesday after driving on Interstate 70 with about 25 pounds of marijuana in the car called into question the actions of the deputy who searched the car without consent.
Public Defender Steve Colvin said Wednesday in court that he had serious concerns about the traffic stop that led to the arrest of 28-year-old Jaivon Umar Bonner, of California; 38-year-old Taraesa Evonne Johnson, of Nevada; and 25-year-old Monese Taylor King. The trio were pulled over by Mesa County Sheriff’s Deputy Mike Miller near mile post 16. When asked by Miller for permission to search the rental car they were in, each of the three refused consent.
“I told all three that I was going to search the car,” Miller wrote in the report.
He found five plastic baggies of marijuana in a suitcase in the trunk, the report said.
Colvin asked Mesa County Judge Michael Grattan to consider the likelihood of conviction in the case when setting bond for Bonner, who will be represented by the public defender’s office.
Prosecutors asked for cash-only bonds for all three defendants, noting criminal histories for each and lack of ties to the area.
Grattan ordered each of them held in lieu of $25,000 cash or surety.
