Driver gets 3 months in crash that killed wife

Dusty Reeves already has been punished enough after killing his common-law wife, Jennifer Torbet, in a drunken-driving crash, friends and family said Tuesday in court.

Despite that, Mesa County District Judge Richard Gurley said Reeves, 24, still should face sanctions for his role in his wife’s death during an Interstate 70 crash the night of March 26.

Gurley sentenced Reeves to three months in Mesa County Jail and five years probation.

Reeves will have to serve six months in jail if he violates any terms of his probation.

Reeves pleaded guilty to charges of vehicular homicide and driving while impaired.

“Dusty lives every day knowing someday he’ll have to tell his son where his mother is and how she got there,” said Michelle Devlin, Reeves’ attorney.

Friends and family implored Gurley not to impose a sentence that would separate Reeves from his child.

At the time of the crash, Reeves and Torbet’s baby, Rodney Reeves, was 5 weeks old. Since the accident, Reeves has been on disability and has been able to bond with Rodney, now 9 months old.

Reeves said in court during his sentencing Tuesday that he didn’t think he was impaired by alcohol when he got behind the wheel. He said Torbet wouldn’t have let him drive if she thought he was drunk.

“I loved that girl,” Reeves said, tearfully. “I never would have done anything to hurt her.”

According to prosecutors, toxicology reports taken from Reeves at the site of the crash indicated his blood-alcohol content was 0.089 more than two hours after the 7:23 p.m. crash.

The legal limit is 0.08.

Devlin said she also had the results tested, and that test indicated Reeves’ blood-alcohol concentration was 0.078, more than two hours after the crash.

Four people, including Torbet, were ejected from the sport utility vehicle Reeves was driving when it rolled near De Beque on I-70.

Torbet, who wasn’t wearing a seat belt, died at the scene.
