Grabe tries insanity defense in son’s death

Judge will consider plea in fatal shooting of boy, 13

A Pear Park man accused of shooting his son to death in September has pleaded not guilty by reason of insanity.

Public defender Steve Colvin entered the plea Wednesday morning on behalf of Allen Grabe, 51.

Mesa County District Judge Brian Flynn said he will review the insanity plea statute and decide Friday whether the plea can be entered formally.

Grabe also is slated for a motions hearing Friday, when Flynn will rule whether the defendant can resume contact with his wife, Jaquette Grabe. Allen Grabe is in police custody.

Grabe has been charged with first-degree murder and child abuse resulting in death in the fatal shooting of his 13-year-old son Jacob while he slept in bed the night of Sept. 11.

Chief Deputy District Attorney Dan Rubinstein said if Flynn accepts the plea Friday, Grabe will be taken to the state mental hospital in Pueblo for a psychological examination to determine whether he’s unfit to be tried on the charges.

“I would be surprised if a doctor came back with that determination,” Rubinstein said after the hearing.

According to an arrest affidavit, Grabe told his wife he had to kill their son because she was “ruining him.”

Jacob Grabe, who was an eighth-grader at Grand Mesa Middle School, had been diagnosed with a neurological disorder called Asperger’s syndrome, which is similar to autism.

According to Allen Grabe’s arrest affidavit, Jaquette Grabe called 911 from inside a closet in the family’s home at 3045 Wedgewood Ave. Law enforcement arrived to find Allen Grabe sitting on the front porch, holding a handgun, but he put it down and said, “I give up,” the affidavit said.
