Man accused in underage drinking party

A Grand Junction man was arrested Saturday on suspicion he was host of an underage drinking party at his house involving 15- and 16-year-old children.

Kevin Dwayne Rutter, 38, 2895 Victoria Drive, was arrested on suspicion of five felony counts of contributing to the delinquency of a minor. He was released from the Mesa County Jail on Sunday afternoon after posting a $7,500 personal-recognizance bond.

Witnesses told authorities it wasn’t the first time Rutter has allowed minors to drink at his house.

Deputies responded to Rutter’s house around 10 p.m. after receiving a noise complaint and a report of a fight. Once they arrived, they contacted Rutter’s son, who allowed them inside to speak with his father. Deputies also saw four teenagers try to head down a hallway and ordered them to sit down in the living room, according to an arrest affidavit.

Rutter’s son told deputies he wasn’t at home when Saturday’s party started but that he had been present on several occasions in the past when his father was drinking with the same teens. The son also said his father’s girlfriend was present during the parties and allowed the teens to drink alcohol on previous occasions, the affidavit said.

Four of the six teens contacted by deputies admitted to drinking shots of rum. A fifth denied drinking alcohol but had bloodshot eyes and an odor of alcohol on her breath.

One of the teenagers then told deputies she had drunk alcohol in front of Rutter and did the same almost every weekend since school started, the affidavit said.

Rutter, who deputies said was visibly intoxicated, initially denied knowledge of underage drinking in his home. He later admitted he was aware the teens were drinking but denied supplying them with alcohol, the affidavit said.

The teens were released at the scene to their parents or given rides home.
