Misdemeanors filed in groin-grab arrest

The Mesa County District Attorney’s Office filed misdemeanor charges Wednesday against a man who allegedly stopped resisting arrest only after his testicles were grabbed by a Mesa County Sheriff’s Department deputy.

Samuel Fazio, 22, formally was charged with resisting arrest and third-degree assault during a brief appearance before District Judge Brian Flynn. Deputy District Attorney Bo Zeerip requested the case be reassigned to county court because a felony wasn’t filed.

Fazio was booked Aug. 22 at Mesa County Jail on suspicion of felony second-degree assault on a peace officer and misdemeanor resisting arrest.

The Sheriff’s Department said Deputy Hassan Hassan used reasonable force Aug. 22 when he briefly grabbed Fazio by the groin to get him to stop resisting arrest. The assault allegation stemmed from claims that Hassan was elbowed by Fazio in the mouth.

Hassan, who was accompanied by a second deputy, was attempting to arrest Fazio on a pair of outstanding warrants, one including criminal impersonation, among other charges. He allegedly failed to appear in court in June in a local burglary case. Fazio also was serving probation in Moffat County following a conviction for attempted theft.
