Sanity report delayed for accused murderer

A report likely to prove pivotal in the case of accused child-murderer Allen Grabe has been delayed.

In a letter addressed to District Judge Brian Flynn, an official with the Colorado Mental Health Institute in Pueblo blamed cramped conditions at the facility after missing a deadline to finish Grabe’s court-ordered sanity evaluation.

“Unfortunately, due to resource constraints in the form of available inpatient beds and the large volume of pending competency, sanity, and mental condition evaluations, we are unable to meet this time frame,” Lori Carter, observations and admissions coordinator at the Pueblo facility, wrote to the judge.

The report was due April 15.

Grabe, 51, pleaded not guilty by reason of insanity in January to first-degree murder of his 13-year-old son, Jacob, at the family’s Pear Park home in September. Jacob Grabe had
Asperger’s syndrome, a neurological disorder similar to autism.

Allen Grabe also is charged with child abuse resulting in death.

Carter wrote in the letter she expects the report will be filed by May 15.

Eunice Wolther, a spokeswoman for the state hospital, said Friday the facility has a waiting list of 26 people who need a court-ordered mental health evaluation.

Jacob Grabe was shot nine times the night of Sept. 11 as he slept in his bed at the family home at 3045 Wedgewood Ave.

According to an arrest affidavit, Grabe fired a first round of shots before stopping to speak with his wife, Jaquette, telling her, “I had to kill him because you were ruining him.”

Grabe returned to the boy’s bedroom and continued firing, the affidavit alleges.

When Mesa County Sheriff’s Department deputies arrived at the home, they found Grabe sitting on the home’s front porch, clutching a revolver.

He said “I give up,” and set the gun down, the affidavit said.

Grabe’s case is scheduled for a review hearing Wednesday.
