Senior won’t be charged in incident
A 91-year-old man at a Grand Junction assisted living facility will not face criminal charges for allegedly groping a female housekeeper last week, according to a Grand Junction Police Department case report.
An investigating officer who handled a reported sexual assault on Dec. 30 — the name of the facility and party names were redacted in the version of the report provided to The Daily Sentinel by the Police Department — determined there was likely probable cause for the crime of unlawful sexual contact but that the victim insisted she didn’t want the elderly man prosecuted.
The victim told police she went to the man’s apartment for routine trash dumping, when he motioned for her to “turn around,” the report said. She did just that, thinking he was about to point out a trash can she’d missed.
“When she did this, (man) told her, ‘You’re working hard today and I think you need a hug, ’ ” the report said. “He then walked up behind her and reached around her and grabbed a hold of a breast in hand and pulled her into himself in a hugging fashion.”
As she pulled away, he reportedly reached out with a hand to “pat her on the bottom,” but she knocked the hand away.
She told police he said to her, “You can go ahead and get on out of here now.”
The report noted he was in his underwear at the time.
Other female staff members at the assisted living facility had complained about the man, including crude comments as female staffers were bending over to get items off a medical cart.
The report said the suspect lives with his wife in the apartment, and that multiple individuals observed he is lucid and “knew the difference between right and wrong.” The victim said she didn’t want him charged, but wanted a stern warning to be issued.
Interviewed by police, the man confirmed much of the victim’s story but insisted he’d “accidentally” groped her. An officer told him he could potentially be removed from the facility if inappropriate comments and behavior continues.
“He told me,” an officer wrote, “in the future he would only be giving hugs to his wife and family.”
