Sex-assault suspect arrested again
Ex-Marine nabbed minutes after pleading innocent to similar charge
A former Marine Corps sergeant was arrested Tuesday on sex assault allegations moments after he pleaded not guilty to identical charges involving the same alleged victim.
Jonathan Douglas Roy, 24, of Lochbuie, was arrested by Mesa County Sheriff’s Department investigators who sat in on Roy’s plea hearing Tuesday afternoon in District Judge Thomas Deister’s courtroom. Roy, who was free on bond and with his attorney, said nothing and shook his head as he was placed in handcuffs.
Neither Roy nor his attorney, Aaron Norris, appeared to know about the new allegations in advance of Tuesday’s hearing. Roy was arrested on suspicion of two counts of sexual assault on a child, one count of sexual assault on a child as a pattern of abuse, nine counts of violating bail bond conditions and nine counts of violating a protection order.
Since posting bond May 28, Roy allegedly met an underage girl four times at a home in Colorado Springs, as well as hotels in Grand Junction and Fruita, according to an arrest warrant affidavit.
The two allegedly had sex during three of those meetings, the affidavit said.
The alleged victim, who authorities have said is 14 or younger, is the same Mesa County girl Roy was accused of assaulting in May.
The girl told investigators she ran away from her home and hitchhiked to the Denver area, where Roy picked her up, and they drove to Roy’s mother’s home in Colorado Springs, according to the affidavit.
She said the meetings started after Roy’s release from the jail in May, but before school started in August. Investigators were told the girl had “spoken by phone almost daily” with Roy since his arrest in May.
Investigators said they confirmed Roy had checked into hotels in Grand Junction and Fruita twice in August.
The girl told authorities she hitchhiked a second time to Roy’s mother’s home in Colorado Springs, while the mother was out of town.
According to the affidavit, investigators worked with the girl to record a phone call to Roy. At the time the call was placed, Roy was in Vail, driving on Tuesday to his scheduled court appearance in Mesa County.
“He told her not to admit anything,” the affidavit said.
“Jonathan then asked her if this call was being taped ... (girl) began to cry, and I hung up the phone,” an investigator wrote.
Roy’s arrest on Tuesday followed a not guilty plea to charges of sexual assault on a child and sexual assault as a pattern of abuse, involving the same girl.
An active-duty Marine assigned to a reserve unit at Buckley Air Force Base in Aurora, Roy was arrested May 20 on the Mesa County allegations. He met the girl at the Grand Junction Air Show in September 2008, and the two allegedly met at least twice at Grand Junction-area hotels and had sex, authorities have alleged. Roy was married at the time.
Sheriff’s Department spokeswoman Heather Benjamin said Roy is no longer a Marine. A Marine Corps spokesman late Tuesday said he wasn’t immediately able to confirm Roy’s status or his departure from the military.
Roy was deployed twice for tours of duty in Iraq, in 2005 and 2006, and was awarded several honors, including the Marine Corps’ Good Conduct Medal.
