If a drunk comes up to your car at a red light and washes your windshield, do you pay him for services rendered?  Payment should only be made for services that one actually contracts for.

Sounds to me like Shaw was paid for services that were contracted for.  If you nod at the drunk and point at the windshield, you contracted for services and yes, you should pay him.  Even if you mistakenly nodded and pointed.
