Retire this junkyard

No one can accuse Mesa County officials of acting hastily in their effort to eliminate an illegal tire dump on 17 acres near De Beque. They began their quest to get the tires removed from Stan Eisenach’s property in 1996, and proceeded through the county’s own process, then the judicial system, to make their case for getting rid of the tires.

Eisenach lost his legal battle in December when the Colorado Supreme Court upheld a state appeals court ruling, and that of Mesa County District Judge Dave Bottger, that said Mesa County had the legal authority to order the tires removed.

On Monday, the Mesa County commissioners approved an application for a $160,000 state grant to pay for removal of the tires and seek reimbursement from Eisenach for the cost of that removal.

It is an important decision. It tells Eisenach and others who thumb their noses at the county’s land-use codes they will be held accountable, no matter how long they try to delay that reckoning.
