Curry switches to write-in after judge dismisses case

State Rep. Kathleen Curry will try to get re-elected as a write-in candidate now that a federal judge has dismissed a case that could have placed her name on the fall ballot.

Curry had joined a lawsuit filed by La Plata County Commissioner Joelle Riddle challenging state laws that prevent unaffiliated candidates from having their names on the ballot if they were associated with a political party at least 17 months before an election.

Like Curry, Riddle had left the Democratic Party and became unaffiliated. Riddle did so in August, Curry in December.

U.S. District Judge Marcia Krieger ruled Wednesday the law existed to protect the integrity of the state’s primary election process.

The Legislature approved a measure this year to allow candidates to get on the ballot if they were unaffiliated by Jan. 1 of that year’s elections, but that new law doesn’t take effect until next year.

Curry, a Gunnison lawmaker who is seeking her fourth and final term for House District 61, will face two others in the race, Republican Luke Korkowski of Crested Butte and Democrat Roger Ben Wilson of Glenwood Springs.
